Failure to do so shall constitute a breach of the Terms of Use, which may result in immediate termination of your Kwontified user account. You shall not: (i) select or use as a username a name of another person with the intent to impersonate that person; (ii) use as a username a name subject to any rights of a person other than you without appropriate authorization; or (iii) use as a username a name that is otherwise offensive, vulgar, or obscene.

Kwontified reserves the right to refuse registration of, or cancel a user account in its sole discretion. You are solely responsible for all activity that occurs on your account and shall be responsible for maintaining the confidentiality of your password. You shall never use another user’s account without such other user’s express consent. You will immediately notify Kwontified in writing of any unauthorized use of your account, or other account related security breach of which you are aware.

(9) FEES AND PAYMENTS

Kwontified reserves the right to require payment of fees for certain features of its service. Should you elect to subscribe to such features, you shall pay all applicable fees, as described on the Website in connection with such features. Kwontified reserves the right to change its price list and to institute new charges at any time, upon 15 days prior notice to you. Such notice may be provided to you via post on the Website or via email. Use of our services following such notification constitutes your acceptance of any new charges.

You agree to indemnify, defend and hold Kwontified and our partners, employees, and affiliates, harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Website.

KWONTIFIED DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU. (16) SEVERABILITY

If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.

(17) TERMINATION

Kwontified may terminate this Agreement at any time, with or without notice, for any reason.
